The legal battle over FinCEN’s Residential Real Estate Reporting Rule is entering a new phase, as Fidelity National Financial Inc. and Fidelity National Title Insurance Co. have formally appealed a federal court ruling that upheld the regulation. In a notice filed April 17, Fidelity is asking the U.S. Court of Appeals for the Eleventh Circuit to review a lower court decision that denied the company’s motion for summary judgment and instead ruled in favor of the U.S. Department of the Treasury and FinCEN.
