The Docket: U.S. Supreme Court Stops Government in Its Tracks

In Marvin M. Brandt Revocable Trust v. United States, the U.S. Supreme Court ruled for a Wyoming property owner fighting the federal government’s effort to construct a bike trail on abandoned railroad tracks. ALTA joined the CATO Institute in submitting an amicus brief supporting the property owner. ALTA’s position is that the railroad rights-of-way created by the act were easements and not subject to an implied revisionary interest.
