I CIVIL ACTIONS
House Bill 1204. Repeals Section 53-2-7 of the O.C.G.A. and substitutes new section. (ALTA® Code I - F) Effective Date: May 1, 2000

ESTATES AND PROBATE
Provides that upon death of an intestate decedent who is the owner of any interest in real property, the title to any such interest which survives the intestate decedent, shall vest immediately in the decedent's heirs at law, subject to divestment by the appointment of an administrator of the estate.

House Bill 656, amends Chapter 3, Title 33 of the O.C.G.A. (ALTA® Code IV - M) Effective Date: July 1, 2000

BANKS/SALE OF INSURANCE
Prohibits banks from selling title insurance unless they were in business of selling title insurance on or before April 1, 2000.

FOR INFORMATION PURPOSE:
House Bill 1084, to amend Title 33 of the O.C.G.A. relating to insurance (ALTA® Code IV - B)

FORMS/RATES/REGULATION/FEES/COMMISSION SPLITS
The title insurance bill that was introduced in the 1999 sessions did not get reported out of committee and is therefore dead.

House Bill 1354, amends Part 1 of Article 3 of Chapter 3, of Title 21 of the O.C.G.A. (ALTA® Code IX - I) Effective Date: July 1, 2000

TAX SALES
Provides for quiet title actions to remove clouds on title caused by equities of redemption from tax sales; may incorporate legal description by referenced to any recorded deed conveying property.

X. RECORDING
House Bill 597, amends Article 2, Chapter 6 of Title 15 of the O.C.G.A. (ALTA® Code X - C) Effective Date: July 1, 2000

RECORDING REQUIREMENTS
Requires clerk to maintain and make readily available to the public, complete, printed copies of the real estate grantor and grantee indices updated regularly, notwithstanding the existence of automated or computerized systems.

House Bill 1601, amends Section 44-14-320 of the O.C.G.A. (ALTA® Code X - C) Effective Date: May 1, 2000

RECORDING REQUIREMENTS
Provides that liens which are not provided for by federal or state statute, county, municipal, or consolidated government ordinance, or specified in a written declaration or covenant which runs with the land shall not eligible or filing and recording.

House Bill 33, amends Article 1, Chapter 5 of Title 48 of the O.C.G.A. (ALTA® Code X - E) Effective Date: April 28, 1999

RECORDING FEES
Eliminates recording fees on releases of preferential assessments after 10 year agricultural covenant expires.

House Bill 279, amends Article 4 of Chapter 18 of Title 50 of the O.C.G.A. (ALTA® Code X - F) Effective Date: July 1, 1999

AUTOMATION
Provides for disclosure of public records whether held by public or private persons or entities; new provision relating to access to computer records by electronic means; fees for electronic access; criminal penalties for refusal to grant access.

Senate Bill 62, amends Chapter 12 of Title 10 of the O.C.G.A. (ALTA® Code X - F)

Effective Date: July 1, 1999

AUTOMATION
Amends the "Georgia Electronic Records and Signatures Act" to change provisions relating to definitions and to add provisions for the legal effect, validity, and admissibility of electronic records, electronic signatures, and secure electronic signatures; to provide for contesting an electronic record or signature on the basis of fraud.
