ALTA Seeks Industry Feedback on Access and Entry Endorsement for Land Under Development

ALTA has opened a public comment period on a newly approved endorsement designed to address legal access concerns for commercial development projects.
The ALTA Board of Governors approved the proposed ALTA 17.3 Endorsement — Access and Entry — Land Under Development on June 23. Before final publication, ALTA is inviting members, policy forms licensees and industry stakeholders to review the endorsement and submit comments.

In commercial property development, borrowers and developers often request coverage that the access points shown on their project plans will have vehicular and legal access to a designated public street. The new 17.3 Endorsement aims to establish a standardized format for industry-wide use, ensuring consistency and clarity in these situations.
The endorsement was developed by the ALTA Forms Committee and approved by the Board of Governors as part of ALTA's ongoing effort to modernize and enhance its policy forms and endorsements.
Following the close of the comment period, the Forms Committee will review industry feedback and determine whether revisions are necessary before final publication. Depending on the outcome of that review, ALTA expects to publish the new endorsement and any related forms revisions shortly thereafter.
The proposed endorsement is available for review on ALTA's website under the section titled "For Public Comment | Recently Adopted Forms – Not Published."
As with other ALTA policy forms and endorsements, use of the form will remain voluntary unless otherwise required by law. The endorsement will be available for use by ALTA Policy Forms Licensees in good standing following final publication.
