Supreme Court Rejects Constitutional Challenge to Tax Foreclosure Sales

July 9, 2026

The June 23 U.S. Supreme Court decision in Pung v. Isabella County, Michigan provides guidance on the scope of property owners' rights following tax foreclosures and further clarifies the court's 2023 ruling in Tyler v. Hennepin County, which held that governments cannot keep surplus proceeds generated from tax foreclosure sales.
