ALTA Endorsements Expand Protection Against Deed Fraud and Forgery

As deed fraud and seller impersonation schemes continue to attract headlines nationwide, ALTA has introduced new tools designed to strengthen consumer protection and reinforce the value of title insurance.
ALTA recently published the ALTA 49 and ALTA 49.1 endorsements, which allow homeowners to obtain post-policy protection against forged deeds and mortgages. The endorsements provide a standardized title insurance solution to address a growing concern among consumers, policymakers and regulators about the impact of real estate fraud. "One of the value propositions of ALTA is public and political awareness of the value of title insurance," said Dan Buchanan, chair of ALTA's Forms Committee and senior vice president and chief title counsel for First American Title Insurance Co. "It's a critical function of ALTA's mission to take the lead in consumer protection."
Responding to a Growing Threat
Stories involving deed theft and seller impersonation have become increasingly common across the country. In many cases, fraudsters pose as property owners, attempt to sell real estate they do not own, collect proceeds from the transaction and disappear. The heightened attention has fueled consumer demand for protection products. At the same time, lawmakers in several states have begun considering legislative responses to deed fraud, some of which could have unintended consequences for real estate transactions and public land records.
Recognizing the need for a reliable, regulated solution, ALTA's Board of Governors asked the Forms Committee to develop endorsements that would expand access to forgery protection for homeowners who do not have an ALTA Homeowner's Policy. The result was the ALTA 49 and ALTA 49.1 endorsements, which were published in August.
How the Coverage Works
The ALTA 49 endorsement, formally titled the Forgery New Owners Policy Residential endorsement, can be issued at the same time as a residential ALTA Owner's Policy. The endorsement provides coverage for loss or damage resulting from a defect in title caused by the forgery of a deed or mortgage recorded in the public records after the policy date in which the insured homeowner was impersonated as the grantor.
The coverage is prospective, meaning it applies to forgery events that occur after the title policy is issued. Existing policy coverages already protect against title defects, including forgery, that occurred before the homeowner acquired the property.
The ALTA 49.1 endorsement extends similar protection to homeowners who already possess an ALTA Owner's Policy and want to add forgery coverage after the fact. Coverage begins on the endorsement date and applies only to forged deeds or mortgages recorded after that date.
Importantly, the endorsements provide homeowners with access to the claims-handling expertise and financial backing of a title insurance company. If a forged deed or mortgage is recorded against a covered property, the title insurer will defend the homeowner's title and cover associated losses and legal expenses necessary to correct the public record, subject to the terms of the policy and endorsement.
With the average title insurance fraud and forgery claim exceeding $143,000, Buchanan noted that the financial consequences of these crimes can be devastating for homeowners.
Building on the Homeowner's Policy
While the new endorsements provide meaningful protection, ALTA intentionally designed them to complement rather than replace the ALTA Homeowner's Policy. The Homeowner's Policy has provided broad post-policy forgery protection for more than two decades. However, that policy is not available in every state and may not be suitable for every residential transaction.
The ALTA 49 endorsements offer a narrower form of coverage focused specifically on protecting the integrity of public land records from forged deeds and mortgages. Buchanan said that approach was deliberate.
"We wanted to maintain the Homeowner's Policy as the gold standard in the industry for coverage for residential property owners," he said.
By limiting the coverage to defects caused by forged deeds and mortgages recorded in the public records, ALTA sought to maximize the likelihood that regulators in states where the Homeowner's Policy is not available would permit the new endorsements.
Expanding Consumer Access
The endorsements are available only for improved one-to-four-family residential properties owned by natural persons or qualifying estate-planning entities. These eligibility requirements mirror those found in the Homeowner's Policy.
ALTA hopes the endorsements will help title professionals respond to consumer questions about deed fraud while providing a practical alternative to unregulated products that merely monitor public records and issue notifications.
As underwriters begin filing the endorsements on a state-by-state basis, availability and pricing will vary by jurisdiction and company. Title agents should consult their underwriters regarding filing status, underwriting requirements and premium structures.
For homeowners concerned about deed theft, however, the endorsements represent an important new option—one backed by the title industry's longstanding expertise in protecting property rights and maintaining confidence in the integrity of land records.
