ALTA Publishes New, Revised Forms

ALTA published a new endorsement for solar equipment on residential transactions as well as several revisions to the ALTA 9, 9.7, 9.10, and 36.6 endorsements to align to the 2021 ALTA Policy Form standards.

These forms (along with applicable redlines) can be accessed here, highlighted under the “Forms Effective August 1, 2025” section.

New Endorsement
  • ALTA 50 Endorsement – Residential Solar – Loan Policy (New Endorsement)

Purpose: The ALTA 50 Endorsement is designed to address originating lenders’ requirements for the deletion of exceptions for recorded documents referencing leased or third-party owned solar equipment, in order to meet Fannie Mae and Freddie Mac selling guide requirements.  

Revised Endorsements

The following endorsements have been revised and updated from their 2006 versions; substantive changes have been made in the exclusions to clarify the scope of coverage:

  • ALTA 9 Endorsement – Restrictions, Encroachments, and Minerals – Loan Policy (Revised and Updated from 2006 version)
  • ALTA 9.7 Endorsement – Restrictions, Encroachments, and Minerals – Land Under Development – Loan Policy (Revised and Updated from 2006 version)
  • ALTA 9.10 Endorsement – Restrictions, Encroachments, and Minerals – Current Violations – Loan Policy (Revised and Updated from 2006 version)
  • ALTA 36.6 Endorsement – Energy Project – Encroachments (Revised and Updated from 2006 version)
ALTA Forms Development Process

ALTA’s Policy Forms committee continues its ongoing work to develop and modify forms to align with legal, regulatory and marketplace considerations. As always, new and revised forms have been developed by the Forms Committee and approved by the ALTA Board. An opportunity to review and comment for new and revised ALTA forms was extended to ALTA members, Policy Forms Licensees and industry customers before final publication. Technical corrections, designed to address smaller non-substantive changes to existing ALTA forms, are published upon the recommendation of the ALTA Forms Committee.

Purpose and Use of ALTA Forms Collection

The forms, in general, are made available for customer convenience. The parties are free in each case to agree to different terms and the use of these forms is voluntary unless required by law. The forms are copyrighted, and use is restricted to ALTA Policy Forms Licensees (including ALTA members) in good standing as of the date of use.
