ALTA Board Approves New, Revised Forms

ALTA’s Board of Governors has approved a recommendation to revise four existing endorsements and adopt three new endorsements that address forgery and solar equipment on residential transactions.

The deadline to comment on the new and revised forms is July 17. Comments may be emailed to [email protected]. The forms may be downloaded in the “For Public Comment | Recently Adopted Forms - Not Published” section. ALTA’s Forms Committee will review any submitted industry comments, and depending on results of the review, the new and revised forms with be published Aug. 1. 

New Endorsements
  • ALTA 49 Endorsement – Forgery – New Owner’s Policy – Residential
    • Purpose: The ALTA 49 Endorsement is designed to address the situation where the homeowner is purchasing an ALTA Owner’s Policy and would like post-policy coverage for deed or mortgage forgery, but where the ALTA Homeowner’s Policy is either not available or is not offered to the homeowner.
  • ALTA 49.1 Endorsement – Forgery – Existing Residential Owner’s Title Policy
    • Purpose: The ALTA 49 Endorsement is designed to address the situation where the homeowner has previously purchased an ALTA Owner’s Policy and would like post-policy coverage for deed or mortgage forgery.
  • ALTA 50 Endorsement – Residential Solar – Loan Policy
    • Purpose: The ALTA 50 Endorsement is designed to address originating lenders’ requirements for the deletion of exceptions for recorded documents referencing leased or third-party solar equipment, in order to meet Fannie Mae and Freddie Mac selling guide requirements. 
Revised Endorsements

The following endorsements have been revised and updated from their 2006 versions. Substantive changes have been made in the exclusions to clarify the scope of coverage:

  • ALTA 9 Endorsement – Restrictions, Encroachments, and Minerals – Loan Policy
  • ALTA 9.7 Endorsement – Restrictions, Encroachments, and Minerals – Land Under Development – Loan Policy 
  • ALTA 9.10 Endorsement – Restrictions, Encroachments, and Minerals – Current Violations – Loan Policy 
  • ALTA 36.6 Endorsement – Energy Project – Encroachments 

As always, the forms have been developed by ALTA’s Forms Committee and approved by the Board of Governors. An opportunity to review and comment is extended to ALTA members, Policy Forms Licensees and industry customers before final publication. The forms, in general, are made available for customer convenience. The parties are free in each case to agree to different terms and the use of these forms is voluntary unless required by law. The forms are copyrighted, and use is restricted to ALTA Policy Forms Licensees (including ALTA members) in good standing as of the date of use.
