ALTA Board Approves Modifications to Best Practices

 Negligence Claim Against Delaware Agent Not Barred by Time

The buyers' claim against a title agent that it was "professionally negligent" in failing to secure a valid access easement for the insured property was not barred by the three-year statute of limitations, because the agent "represented" that the property had access, extending the time to sue until the buyer discovered the problem. Also, the court said the buyers could not sue the title agent for malpractice, but they might have a valid claim for negligent procurement of insurance.

First American Financial reported there is no preliminary indication of large-scale unauthorized access to customer information after it shut down external access to a production environment with a reported design defect that created the potential for unauthorized access to customer data. Maryland Governor Signs RON Bill

Maryland Gov. Larry Hogan recently signed Senate Bill 678 into law enabling remote online notarizations (RON). In April, Maryland’s legislature passed the bill, which modifies the state’s Uniform Law on Notarial Acts and allows for remote online notarization for real estate transactions. The legislation will go into effect Oct. 1, 2020.

During the 2019 Advocacy Summit, ALTA honored individuals and entities for their effort in helping to raise donations in 2018 for the Title Industry Political Action Committee (TIPAC). In 2018, TIPAC raised $551,980 from 979 contributors. This made the 2017-2018 election cycle TIPAC’s most profitable cycle and secured it as a million-dollar PAC.

The average time to close decreased to 40 days in April, down from 42 in March, Ellie Mae reported. The average time to close a refinance decreased to 33 days, while the time to close a purchase dropped to 43 days in the month.
FinCEN Reissues Real Estate Geographic Targeting Orders for 12 Metros

The Financial Crimes Enforcement Network (FinCEN) renewed its Geographic Targeting Orders (GTOs) that require U.S. title insurance companies to identify the natural persons behind shell companies used in all-cash purchases of residential real estate. The new GTOs run through Nov. 11. FinCEN said it appreciates the continued assistance and cooperation of the title insurance companies and ALTA in protecting the real estate markets from abuse by illicit actors.

Anti-Money Laundering Bill Passes Committee With ALTA Changes

The initial discussion draft of "Coordinating Oversight, Upgrading and Innovating Technology, and Examiner Reform Act of 2019" included a provision to expand the FinCEN Geographic Targeting Orders to cover commercial real estate transactions on the same terms as residential transactions (e.g. cash purchases over $300,000). Also included was a provision to affirmatively cover transactions made using a like kind exchange. Due to efforts by ALTA members and staff, edits were made to the language requiring FinCEN to issue a unique GTO on commercial real estate.
How Have the 2017 Tax Law Changes Impacted Real Estate Prices?

Enacted in 2017, the Tax Cuts and Jobs Act reduced tax breaks for homeowners. At the time, many in the real estate industry expected the changes to negatively impact the housing market, particularly in high-priced neighborhoods. The industry concern primarily focused on two specific changes included in the bill: the mortgage interest deduction was limited to loans of $750,000 or less, down from a previous cap of $1 million, and the deduction for state and local (property) taxes was capped at $10,000. WFG Lender Services Announces Five-second Title Report

According to WFG, the DecisionPoint platform uses a proprietary algorithm that delivers a full, detailed title report within five seconds, alerting lenders whether the loan is “clean,” meaning it can close within a matter of days, or needs some curative measure that will take longer to rectify before a title insurance policy can be issued.

 New York Reminds Title Companies of New Regs, Rate Requirements

The regulations require title insurance companies to submit new rate applications to establish rates to be charged in the future that exclude all expenses deemed to be prohibited under the regulation. In its letter, the NYDFS said that all title insurance policies issued after Feb. 15, 2019, at rates that don’t reflect compliance with the regulation will be in violation of New York law.

The New York Department of Financial Services disapproved of Fidelity National Financial’s application to acquire Stewart Title Insurance Company, a New York-domiciled title insurance company that is licensed only in New York.
