California Office of Administrative Law rejects Garamendi Proposed Rate Regulation

The CA OAL yesterday rejected the Garamendi led proposal to roll back title insurance premiums. In addition to the rate cut, the plan would have implemented a burdensome and perhaps unworkable statistical collection plan. The OAL has not yet released their written rationale for the decision which is expected in about seven days. They rejected the proposal for not meeting "Clarity and Reference standards", failure to meet requirements of incorporation by reference and a failure to contain all documents or defective documents. It is unclear whether the department under its new Commissioner Steve Poizner will attempt to correct and resubmit the proposal. ALTA will provide further analysis and news as it becomes available.
