I. Civil Actions

F. Estates and Probate

Senate Bill 41: - Amends Kansas Estate Tax Act to eliminate any outstanding inheritance tax liability as of 7/1/2008 for those estates for which no return has been filed by that date - Signed by Governor on 4/3/2001.

IV. Insurance/ Business Issues

House Bill 2480: - Privacy notices - in Conference Committee. HB 2480, as amended, concerns the privacy of consumer financial and health information and amends the Insurance Commissioner’s authority to adopt privacy rules and regulations regarding the disclosure of nonpublic personal information described in Title V of the Gramm-Leach-Bailey Act of 1999.

A. Agents/Abstractor Licensing

Senate Bill 123: - Uniform insurance producers licensing act - Signed by Governor on 4/4/2001.

H. Controlled Business

House Bill 2209: - Controlled business - in House Insurance Committee.

Senate Bill 143: - Controlled business - Senate version of House Bill 2209.

V. Statutory Liens -

A. Mechanics’ Liens

House Bill 2212: - Extends time for filing mechanic’s liens for contractor and subcontractor liens and against property other than residential property to within 180 days after the material, equipment, or supplies was used or consumed - in Conference Committee.

Senate Bill 197: - Extends time for filing mechanic’s liens - amended into Senate Substitute for House Bill 2212.

B. Judgment Liens

House Bill 2175: - Provides that a Chapter 61 judgement lien must be filed in the county where a case was originally filed before a lien can subsequently be filed in any county where the judgement debtor’s real property is located - in Conference Committee.

D. Child Support Liens

House Bill 2508: Establishes Kansas payment center - in Conference Committee.

VI. Taxes

A. Real Estate

Senate Bill 92: - Would amend the statute relating to fair market value for property taxation purposes, to provide that the value of any special assessment not be considered in such determination of fair market value - passed Senate, in House.

VIII Real Property Interests

H. Trusts

House Bill 2148: - Concerns trusts and provides a procedure for certification of a trust. The bill provides that a certification of trust may be used to establish the existence and terms of a trust, and that a person who acts in reliance upon such a certification without knowledge that representations are incorrect is not liable to any person for such actions - Signed by the Governor 3/27/2001.

Senate Bill 30: - Amends a law dealing with the preparation of wills by persons who are also the primary beneficiary to expand the law to cover both wills and trusts. It amends who may be named in a will or trust as devisee - Passed Senate, in House.

IX. Deeds and Security Interests

B. Financing Statements

House Bill 2487: - UCC amendments - amends 2000 law changes to UCC secured transactions which become effective July 1, 2001 - see New Section 72, Filing Offices.

D. Foreclosures

House Bill 2160: - Permits a city to initiate a judicial tax foreclosure sale - passed House, in Senate.

E. Mortgages/Deeds of Trust

House Bill 2481: - Amends Kansas mortgage business act - Signed by Governor 4/3/2001.

House Bill 2482: - As amended, concerns the powers and duties of the State Banking Board and the Bank Commissioner and the general power of banks - Signed by the Governor 4/3/2001.

F. Reconveyances/Releases

Senate Bill 70: - Concerns the persons who may make a demand upon a mortgagee or assignee of a mortgage for the entering of satisfaction of a mortgage - Signed by the Governor 3/20/2001.

K. Legal Description/Land Surveys

House Bill 2406: - Review of plats by county surveyor - in Conference Committee.
