A federal appeals court issued its long-awaited decision today in an appeal by PHH Corp. of its $109 million fine by the Consumer Financial Protection Bureau (CFPB) for alleged RESPA section 8 violations. The court affirmed the application of RESPA, as it had been followed previously by HUD. While also holding that the structure of the CFPB is unconstitutional, the three-judge panel rejected the idea of shutting the bureau down.

The bill would turn the Consumer Financial Protection Bureau into the Consumer Financial Opportunity Commission, switch leadership to a five-member board and give it a new mission of "protecting consumers by enforcing the law and promoting market competition." The bill also would amend the Ability-to-Repay/Qualified Mortgage provision in Dodd-Frank to exclude title and certain escrow charges if they are paid to an affiliate of the originator under the law's calculation for the three-percent cap for points and fees. Title fees paid to a non-affiliated title company are already exempt.

ALTA has created several documents to help members comply with the Financial Crimes Enforcement Network's expanded Geographic Targeting Orders, which requires all U.S. title insurance companies to identify the individuals behind companies used to conduct high-end, all-cash real estate transactions in six major jurisdictions. The GTOs go into effect Aug. 28 and apply to underwriters’ subsidiaries and agents. ALTA has developed a FAQ that highlights the basics of the GTO, covered jurisdictions, what information must be collected and criminal penalties for not complying; a form to help determine if a transaction is reportable; a form to aid in the collection of information; and a graphic to educate real estate agents about the order.
FHFA Offers New Streamlined Refi Product, Extends HARP Through September 2017

The Federal Housing Finance Agency (FHFA) announced that Fannie Mae and Freddie Mac (GSEs) will implement a new refinance offering aimed at borrowers with high loan-to-value ratios. Because this new offering will not be available until October 2017, the FHFA is extending the Home Affordable Refinance Program (HARP) through Sept. 30, 2017.

Changes address ACH transactions and international wire transfers, clarify requirements associated with maintaining and disposing of non-public personal information, add standards for engaging third-party signing professionals, and modify the time frame that title insurance agents must report title insurance policies and remit premiums to their underwriters. The CFPB staff stated that the term “homeowner’s insurance” as used under the rule includes flood insurance. According to Richard Horn of Richard Horn Legal PLLC, the CFPB noted that the flood insurance payments would be reflected in the Escrow tables on page four of the Closing Disclosure, “but they did not explicitly state how it would be referred to (i.e., as Homeowner’s Insurance or Flood Insurance).”

FinCEN issued updated FAQs for its Geographic Targeting Orders that require several title insurance underwriters to identify the names of individuals involved in shell companies and other legal entities that make all-cash purchases for residential transactions that exceed $3 million in Manhattan, N.Y., and exceed $1 million in Miami-Dade County, Fla. All covered transactions that settle between March 1 and Aug. 27, 2016, must be reported. The updated FAQs address when there are a series of transactions that close separately, if a photo ID must be obtained of every member of an LLC and the impact ancillary settlement charges have on whether the transaction is reportable.

CFPB Releases Fact Sheet for Construction Loans Under TRID

The Consumer Financial Protection Bureau (CFPB) released a fact sheet to clear up confusion on whether the TILA-RESPA Integrated Disclosures (TRID or Know Before You Owe) should be used on construction loans. According to the fact sheet, most construction loans that are closed-end consumer credit transactions secured by real property are covered by the Know Before You Owe mortgage disclosures. A construction loan that is an open-end transaction or a loan for a commercial purpose is not covered. Additionally, the CFPB provides guidance on disclosing construction loans with permanent financing as one loan or two loans.
