1998 State Legislative Report - Washington

Contact: June Mulcahy

I CIVIL ACTIONS
HB 2297 - Liberalized filings procedures. Made minor changes in such things as Margin requirements, etc. WLTA supported the legislation. Sponsored by Reps. Sehlin and Hankins. Passed.

II ENVIRONMENTAL ISSUES
III. ESCROWS
IV. INSURANCE / BUSINESS ISSUES
V. STATUTORY LIENS
VI. TAXES
VII. PUBLIC ENTITIES
SB 2584 - Adverse Possession - Basically abolished adverse possession. The bill had about 30 sponsors and died in Rules. WLTA opposed this legislation. We expect similar legislation in the January 1999 session.

SSB 6317 - Adverse Possession - Similar to SB 2584 - This one also had a number of sponsors and also died in rules. WLTA opposed this legislation.

ESHB 6323 - Adverse Possession/Timberlands- Changed the adverse possession laws with respect to timberlands only. For political reasons, WLTA took no position on this particular piece of legislation.

VIII. REAL PROPERTY INTERESTS
IX. DEEDS AND SECURITY INTERESTS
ESHB 619la -- Deeds of Trust - This legislation caused us major concern as one Section eliminated the third party from reconveyances. Clearly, we opposed this we opposed this section and were able to get it removed from the bill. With that section gone, we had no further objections to the bill and in fact supported its passage.
