2000 State Legislative Report - Alaska

The following is a brief summary of several of the bills which the Alaska Land Title followed this pass session. Please refer to specific bills for details. These can be found at http://www.legis.state.ak.us/basis21.htm

The prime bills which we have been following and their final status are:

I CIVIL ACTIONS
HB275 Uniform Probate Code/Trusts/Property Includes ability to vest in trust without trustees name. (Senate Judicial) (no position). Passed.

HB296. Uniform Partnership Act. Dealing with partnerships and Limited Liability Partnerships. Passed. (ALTA® - no position)

V. STATUTORY LIENS
HB376 Mechanic-Materialmen Lien duration.. A bill which would extend lien period to 1 year with 1 year extension. . (House Labor & Commerce) (ALTA® opposed bill) Did not pass.

VIII. REAL PROPERTY INTERESTS
SB252 RS2477 State Rights-of-Way (ALTA® supported original version). The original bill would have allowed surveying or location of RS2477 right-of-way trails prior to recordation HOWEVER when it got to Halford's committee (Senate Resource) he introduced CSSB252 which amended original bill to delete the list of trails and survey requirements but added a section with regards to property in municipality of less than 41 acres. In effect it does not really change the current law and Halford still has what he wanted and got in 1998. ALTA® and DNR opposed.(Senate Finance- did not pass)

IX. DEEDS AND SECURITY INTERESTS
HB239 Uniform Commercial Code. This bill includes requirement that all UCC filings be done in one place, with fixtures recording done in the district where property located. (ALTA® supported) Passed.
