The Docket: Court of Appeals Affirms Title Companies’ Duties in Closing Suit

Today’s review of a case addressing condominium regulation exceptions and the role of an escrow agent at closing by the Houston First District Court of Appeals was provided by Shawn Briner and Caitlin Stayduhar of the law firm Martin, Leigh, Laws & Fritzlen PC. This case illustrates that insurers should watch for potential litigation between the insured and insurer or between the insured and a third party and must adjust their document retention policies accordingly. Additionally, the case provides guidance on whether an escrow agent is responsible for investigating or disclosing title defects discovered while closing the transaction.
